Etnahills provides this booking platform for visitors to take advantage of tourist services. The contracts are concluded directly between users and Etnahills.

General contract conditions of Etnahills

Etnahills, operates on a trading platform that provides offers in the tourism sector as online promotions through the Internet and mobile applications. On the platform users have the opportunity to find and book excursions, activities and tourist experiences all over the world. Offers are uploaded online from Etnahills.
For the purposes of these Sales Commercial Terms the following applies:

Article. 3, lett. a), Cod. cons., qualifies the consumer or user as “the natural person acting for purposes unrelated to any business, commercial, craft or professional activity carried out”.
Article. 2555 c.c. defines the company as «the set of assets organized by the entrepreneur for the business of the company»
The “User” refers to a natural person, unless that person is expressly registered as a legal entity on Etnahills. Acts and omissions in the registration of the legal person will be attributed to a natural person, unless that person acts within the faculties of a representative for a juridical person.

These Sales Conditions of Sale will be applied for the use of Etnahills, for example through the Internet or mobile applications. The contractual relationship between the user and Etnahills includes the correct consultation of the user towards the final service. Etnahills acts as an organizer, landlord, seller or other contractual partner in reference to the services contracted by the user. These Terms of Sale of Etnahills will apply for user consultations towards the choice of the final service.

Some uses of Etnahills, such as the initiation of reservations, require registration. During registration, the user sends an electronic registration form, accepting the Sales Conditions. Following the registration is confirmed by Etnahills. Individuals must be at least 18 years of age.

Etnahills Services / Contract Stipulation
After the user has made a request for a service (eg destination, type of visit, start time, number of participants, and price options) on the Etnahills website, information will be available to the user. on sclelti services (“service information”). Based on this information and after checking the availability, if necessary, the user can send a contractual offer to be forwarded to the supplier to place the order. This is done by clicking on the “make reservation” button.
Etnahills will provide the user with the transport conditions with relative terms and conditions for the correct administration of the services.
Etnahills will provide the user with a confirmation of booking and payment. The use of Etnahills is, as a rule, free by users. You will be responsible for the costs of accessing Etnahills (eg Internet access).
Etnahills will send any data for the use of the services selected in accordance with the current valid conditions (such as ticket information) after these have been completed.

Etnahills guarantees the accuracy of the information forwarded, guarantees the performance of the services.

The service contract stipulated with Etnahills will regulate the compensation that the user must pay to Etnahills for the services offered by him. Etnahills will be authorized to draw up invoices for this compensation. Payment in favor of Etnahills
If the user needs to pay in a currency other than the currency in progress in his country, (foreign currency requirement), Etnahills may request payment in the user’s local currency and convert the foreign currency requirement according to the current exchange rate . The contact partner of the user for a service contract and the related compensation will be the respective supplier and the contractual partner. The user can request compensation for compensation only from the correct contact partner.
The user must register in order to use the Etnahills payment functions. Etnahills may reject the payment method provided by the user. The payment methods approved for the related services are indicated to the user during the order process.
By authorizing the payment, the user accepts that the payment information is used by the applicant to collect the compensation. Etnahills reserves the right to make use of the Etnahills payment functions depending on the credit rating of the user.

All prices on Etnahills are shown per person and include VAT and other taxes.

Duties and obligations of the user
Users will process the registration data (username and password) confidentially and will not allow third parties to access Etnahills with their data. The use of Etnahills during the registration of the user will be attributed to the latter.
After receiving the service information, the user can send any order to Etnahills to be forwarded to the supplier.
You will indemnify Etnahills about claims made by third parties caused by your use of Etnahills, except to the extent that Etnahills is attributable to such claims.

Availability and guarantee

Etnahills will have no jurisdiction over items such as availability, quality, service features or technical support. Etnahills may alter, limit, or suspend its online Etnahills portal at any time and at its discretion. The existing agreements between the user and the supplier, as well as their management, will not be affected by these changes.
Etnahills will not be liable for the correctness or completeness of the data provided by third parties (such as other suppliers).
Etnahills will not assume any responsibility for the services offered by the suppliers, unless it is the supplier of the service itself. The contact person of the user for questions and requests related to a service contract and its implementation will be the relevant supplier.
As for Etnahills, this will not assume any obligation towards the user, moreover Etnahills offers no guarantee.
Limitation of liability
Etnahills will be responsible for the damages attributable to Etnahillso to its auxiliaries caused intentionally or through gross negligence.
In cases of simple negligence, Etnahills will be responsible for the violation of an essential contractual obligation and only for foreseeable and typical damages. The essential contractual obligations will be constituted by those obligations that make the execution of the contract possible and from which the user generally depends.
The limitations of liability do not apply within the framework of the guarantees provided, in the event of injury to life, body and health, or in the case of claims arising from the Product Liability Directive.

Users can stop their registration on Etnahills at any time by disabling the user account. Etnahills can interrupt a one-sided registration with one week’s notice. The rights previously activated will not be altered. The right of extraordinary interruption will not be altered.

Etnahills reviews function
Users have the ability to personally influence the contents of Etnahills, writing travel reports in the form of reviews or posting images (“user content”). Users respond fully to the content posted by them and take responsibility for them. Users will ensure the correctness of the contents and will ensure that they do not contain misleading or inappropriate statements or information. In addition, users will ensure that their content will not affect the rights of third parties. Etnahills only provides the platform and will not assume any responsibility for the user content, nor will it make them their own.
Etnahills can use user content in various ways. Among which, among other things, the visualization on the website, the reformatting, the management aimed at improving clarity and grammar, inclusion in advertisements or other works.
Etnahills may remove or re-insert user content if necessary and in its sole discretion. Etnahills can, for example, remove user content if it is Etnahills’ opinion to violate its principles on content. Etnahills will not be obliged to keep copies of user content or provide such copies. Etnahills does not guarantee the confidentiality of user content.
Etnahills and its partners may show advertisements and other similar information or alongside user content on the website and in other media. Users will not be entitled to any compensation for such advertisements. The right to make changes to the nature and extent of such advertisements will be reserved and users will have no right to be warned about it.
The user will fully release Etnahills from all claims of third parties upon initial request (including reasonable charges for legal advice fees) that such third parties may advance against Etnahills with respect to the contents entered by the user. This condition will apply even if content that is the subject of contention is no longer available on Etnahills. This condition will not be applied if Etnahills is responsible for this violation. In case of claims made by third parties, users will provide Etnahills with all the information necessary to examine such claims and a defense, promptly and truthfully and completely.

Data protection
Etnahills will collect the users’ personal information for the period of time necessary to establish, manage or change the status of the contract for Etnahills, between the user and Etnahills
To the extent that Etnahills is included in the communication of a service contract between the user and the relative supplier, it sends to the latter the requested data necessary for the conclusion of this contract. The supplier then manages and uses the data to start the contract, terminate the contract and execute the contract under his responsibility. The identity of the relevant supplier is deductible from the booking conversation.

Changes to these Conditions of Sales
Etnahills reserves the right to modify these Sales Commercial Terms at any time, without notice and without motivating such modifications. Etnahills will make these changes only with respect to consumers, as users can reasonably expect to admit them, considering the mutual interest of the parties. These include, for example, a lack of uniformity between services and considerations, but also regulatory loopholes and legislative changes. The change to the Terms and Conditions of Sales will be sent to users by e-mail at least two weeks before it enters into force. If a user does not object to the validity of the new Sales Commercial Terms within two weeks of receiving the e-mail, changes to the Sales Conditions will be deemed accepted. Etnahills will specifically inform the user about the meaning of this deadline in the e-mail containing the change to the Conditions of Sales.

Other provisions
These Sales Conditions of Sale constitute the complete agreement between Etnahills and the user. There are no other additional agreements. To be valid, changes and additions to this agreement will be required in writing, text forms (eg e-mail) will not be sufficient. Clause 12 of these Sales Commercial Terms will not be conditioned by the requirement of the written form.
The law of the Italian Republic will apply. If you have placed an order as a consumer, and at the time of ordering your habitual residence is in another country, the application of the mandatory laws of that country will not be affected by the competent jurisdiction as stated in sentence 1.
If the provisions of these Sales Conditions of Sale are or will become invalid, this will not affect the validity of the remaining provisions.

Booking Acceptance
The supplier only accepts bookings from persons fully capable of acting and with full legal competence. Legal entities must act through a duly authorized person.

True information
The information provided on the Etnahills booking platform is accurate. The user reserves the right to cancel reservations when incorrect information has been provided. In this case, the price paid will not be reimbursed.

Arrival at the headquarters and respect for the rules
The user is responsible for arriving on time at the meeting point. If a trip from abroad is planned to reach the headquarters, you are personally responsible for the necessary travel documents (passport, etc.), current health regulations, etc.

Conditions of participation
You are personally responsible for compliance with all participation conditions. The provider reserves the right to exclude participants from the activity who do not meet these conditions. In this case, the price paid will not be reimbursed.

Contract binding nature
The contract between the user and the supplier is concluded when the suppliers accept the reservation request. By booking a tour or other activity, you are submitting a binding offer to the supplier. If the supplier accepts the offer, the contract is finally concluded. You will be notified by e-mail.

Your credit card will be charged at the time of booking. If the supplier does not accept your request the full amount will be reloaded to your credit card.

Exclusion on the right of withdrawal
In the event that the law applicable to the contract between the user and the supplier grants the right of withdrawal in favor of the consumer, this right is waived, to the extent permitted by law.

Personal responsibility for insurance
Insurance is not included in the price. You are personally responsible for sufficient insurance coverage. The type of insurance depends on the activity booked.

Unpaid services
If you do not pay for the booked service or the payment will be canceled, your service request will be canceled. This will be considered as a cancellation and cancellation charges will be applied according to section 11.

All communications between the user and Etnahills must be made through the Etnahills booking platform. To this end, only the forms provided by Etnahills must be used. The messages, which are not managed through the Etnahills reservation platform or through the modules provided for this purpose, can not be accepted by the supplier.

Cancellation policy
If the activity is canceled, the cancellation conditions on the Etnahills confirmation voucher are considered valid. We recommend that the client carefully read the information on the Etnahills voucher.

It reserves the right to demonstrate that the supplier has suffered a lower loss through cancellation, based on what is indicated by these rules.

The refund will be made within 20 working days of being credited to the credit card used.

If the payment by credit card before using the booked service is not honored or revoked, this will be considered as a cancellation of the booking and the cancellation policies indicated will apply. Additional claims for damages are reserved.

Extraordinary cancellations
The supplier may cancel the activity, without adhering to the cancellation period if the weather conditions, government actions, unpredictable or unavoidable external circumstances endanger or make it impossible or essentially difficult to carry out the activity

This is done with the exclusion of any damages or other claims based on the legislation in force.

Exclusion from participation
The provider has the right to refuse admission or exclusion from an activity if you do not meet the eligibility requirements, or if your participation puts you or others at risk, or otherwise hinders the proper performance of the activities. In these cases, the price paid can not be reimbursed.

Program changes
The supplier also reserves the right to make minor changes to the program, if deemed necessary due to a fortuitous or unpreventable case.

Responsibility of the tour provider or tourist service
The tour provider or tourist service provider is responsible under applicable law. Liability is excluded to the extent permitted by applicable law.

These general terms and conditions are subject to change without notice. The conditions valid at the time of each booking apply.

Applicable law
